Felune does not require clients or prospective clients to provide unnecessary sensitive information.

In particular, the initial website enquiry form is intended for basic enquiries only. People are asked not to include detailed medical, mental health or other highly sensitive information in an initial enquiry.

More detailed information can be discussed during an appropriate consultation and collected when it is reasonably necessary for the provision of services.

Felune Social Work recognises that clients share personal and sensitive information in the context of a professional relationship and has a responsibility to protect that information.

Information provided to Felune will be treated confidentially and will only be accessed, used or disclosed for appropriate purposes and in accordance with applicable privacy laws, professional obligations and the individual's consent.

Who Can Access Your Information?

Access to client information is limited to people who have a legitimate and appropriate reason to access it.

As an independent Social Work practice, access to client records is primarily managed by Annika Kamphuis.

Where information needs to be shared with another person or organisation, this will generally occur with the client's knowledge and appropriate consent, unless an exception applies under law.

Sharing Information With Consent

With your consent, relevant information may be shared with people involved in your support, such as:

Limits to Confidentiality

Confidentiality has limits.

There may be circumstances where Felune Social Work is permitted or required to disclose information without your usual consent.

This may include circumstances where:

  • Disclosure is required or authorised by law

  • There is a serious or imminent threat to a person's life, health or safety

  • Disclosure is necessary to meet a legal or regulatory obligation

  • Disclosure is required in response to a valid legal process, such as a subpoena or warrant

  • Disclosure is otherwise permitted or required under relevant Australian legislation

Where disclosure is permitted or required without consent, Felune will seek to limit the information disclosed to what is reasonably necessary in the circumstances.

Safety and Risk

Where there are concerns about the safety or wellbeing of a client or another person, Felune Social Work may need to take appropriate action to manage the risk.

The steps taken will depend on the circumstances, applicable law and professional obligations.

Where possible and appropriate, the client will be informed about the need to share information and the reasons for doing so.

Children and Young People

When providing Social Work services to children and young people, confidentiality will be considered alongside the rights and responsibilities of parents, guardians and other authorised representatives, as well as the child's or young person's age, maturity, circumstances and applicable legal requirements.

Information will not automatically be shared with a parent or guardian simply because they are involved in a child's care.

The approach to confidentiality and information sharing will depend on the circumstances and applicable legal and professional requirements.

Your Role in Information Sharing

Where consent is required, you will be given an opportunity to understand what you are consenting to before information is shared.

NDIS-Related Information

Where you receive NDIS-related Social Work support, relevant information may be shared with the NDIS, NDIA, support coordinators, plan managers or other providers where this is necessary for the delivery, coordination, administration or documentation of your support and where appropriate consent or another lawful basis applies.

Felune will not assume that being an NDIS participant gives general permission to share your information with all NDIS-related organisations.

Where relevant, information may also be shared with a plan manager for the purpose of processing invoices, payments or other funding administration, where appropriate consent or another lawful basis applies.

Parents, Guardians and Authorised Representatives

Where a client has a parent, guardian, nominee or other authorised representative, Felune will consider the person's legal authority and the circumstances of the client before sharing information.

For children and young people, information sharing will take into account the child's or young person's age, maturity, circumstances, consent where appropriate, the authority of the parent or guardian, and applicable legal and professional requirements.

Third-Party Service Providers

Felune may use external providers to support the operation of the practice, such as technology, communication, document storage, accounting or payment services.

Where these providers handle personal information on behalf of Felune, appropriate privacy and security considerations will apply.

Storage and Security

Felune Social Work takes reasonable steps to protect personal and sensitive information from misuse, interference, loss, unauthorised access, modification or disclosure.

How Information Is Stored

Client and business information may be stored and managed using Microsoft 365 services included in Felune Social Work's Microsoft 365 Business Basic subscription, including:

  • Microsoft Forms

  • Microsoft Outlook

  • Microsoft OneDrive

  • Microsoft SharePoint, where applicable

  • Microsoft Word and other Microsoft 365 applications used for client documentation

The specific systems used to store information may depend on the type and purpose of the information.

Access to Information

Access to personal and sensitive information is restricted to authorised individuals who require access for legitimate professional or administrative purposes.

As an independent Social Work practice, access to client records is primarily managed by Annika Kamphuis.

Felune does not provide general access to client records and will take reasonable steps to prevent unauthorised access.

Security Measures

Felune Social Work uses reasonable technical and organisational measures to protect information, which may include:

Clients are encouraged to use secure email accounts and devices when receiving, storing or sending documents containing personal or sensitive information.

Overseas Processing and Disclosure

Some personal information held by Felune Social Work may be stored, processed or accessed outside Australia through third-party technology and service providers used to operate the practice.

Felune Social Work currently uses Microsoft 365 Business Basic for business and professional purposes, including Microsoft Forms, Outlook and Word.

Depending on the service and its configuration, information may be stored, processed or accessed in Australia or overseas.

Felune Social Work will take reasonable steps to manage personal information in accordance with applicable Australian privacy laws, including Australian Privacy Principle 8 where applicable.

Where practicable, Felune will identify relevant overseas processing or disclosure arrangements and consider the privacy protections applicable to those arrangements.

Retention of Information

How Long We Keep Information

Felune Social Work retains personal information for as long as it is reasonably necessary for the purposes for which it was collected, or as required by applicable legal, regulatory or professional obligations.

When personal information is no longer required for these purposes, and there is no legal or other applicable requirement to retain it, Felune Social Work will take reasonable steps to securely destroy or de-identify the information.

When Services End

Responding to a Data Breach

If Felune Social Work becomes aware of an actual or suspected data breach, reasonable steps will be taken to contain the breach, assess the potential impact and prevent further unauthorised access or disclosure.

The circumstances of the breach will be assessed to determine what information was involved, who may be affected and whether notification or other action is required under applicable privacy laws.

Notification

Where a data breach is required to be notified under the Notifiable Data Breaches (NDB) scheme, Felune Social Work will take the required steps to notify affected individuals and the Office of the Australian Information Commissioner (OAIC).

Where appropriate, Felune may also notify other relevant regulatory or professional bodies.

The NDB scheme applies where an eligible data breach has occurred and the relevant legal criteria for notification are met.

Managing and Reviewing Breaches

Felune Social Work will document and review relevant data breaches and take reasonable steps to address the cause of the incident and reduce the risk of a similar incident occurring again.

Anonymity and Pseudonymity

Where it is lawful and reasonably practicable, you may choose not to identify yourself, or you may use a pseudonym when making an enquiry or interacting with Felune Social Work.

However, anonymity or pseudonymity may not be practical or appropriate when providing Social Work services.

Felune may need to collect identifying information where it is necessary to:

  • Provide services

  • Communicate with you

  • Maintain accurate professional records

  • Manage safety and risk

  • Process payments

  • Meet legal, regulatory or professional obligations

If you choose not to provide information that is reasonably necessary for these purposes, Felune Social Work may not be able to provide the requested service or respond fully to your enquiry.

Direct Marketing

Felune Social Work does not use personal or sensitive client information for unrelated direct marketing purposes.

Personal information collected in connection with the provision of Social Work services will not be used to promote unrelated products, services or businesses without an appropriate lawful basis and, where required, consent.

Where Felune Social Work sends communications that may constitute direct marketing, appropriate consent and opt-out requirements will be followed.
